1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Taskbeast website, applications, and related services (collectively, the "Services") operated by Endelbyte srl ("Taskbeast", "we", "us", or "our"). By creating an account or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. Eligibility and Account

You must be at least 16 years old and able to form a binding contract to use the Services. You are responsible for the accuracy of the information you provide and for safeguarding the credentials used to access your account. You must promptly notify us of any unauthorized use of your account.

You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that violate these Terms, applicable law, or our acceptable use expectations.

3. Subscriptions and Payments

Certain features of the Services are provided on a subscription basis. By subscribing, you authorize us (and our payment processor, Stripe) to charge the applicable fees to your selected payment method on a recurring basis until you cancel.

Fees are billed in advance and are non-refundable except where required by law. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and you retain access to paid features until then.

We may change pricing or introduce new fees with reasonable advance notice. Continued use after the change takes effect constitutes acceptance of the new pricing.

4. Acceptable Use

You agree not to:

• Use the Services for any unlawful, fraudulent, or harmful purpose.
• Send unsolicited messages, spam, or content that violates WhatsApp's or any other connected platform's policies.
• Reverse engineer, decompile, or attempt to extract the source code of the Services, except where permitted by law.
• Interfere with or disrupt the integrity or performance of the Services or the data contained therein.
• Use the Services to build or train a competing product.
• Upload or transmit malware, or attempt to gain unauthorized access to any system or account.

5. Your Content and Data

You retain all rights to the content you submit to the Services ("Your Content"), including reservations, guest details, and messages. You grant us a worldwide, non-exclusive license to host, process, and transmit Your Content solely as needed to operate and improve the Services.

You are responsible for ensuring you have the necessary rights and lawful basis to share guest data with us, particularly when the data concerns individuals located in the European Economic Area.

6. Third-Party Integrations

The Services integrate with third-party platforms such as Airbnb, Booking.com, WhatsApp Business API (Meta), Google Calendar, and others. Your use of those platforms is governed by their respective terms. We are not responsible for the availability, content, or practices of third-party services, and we may modify or discontinue any integration at any time.

7. Intellectual Property

The Services, including all software, designs, text, graphics, and trademarks, are owned by Endelbyte srl or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms. No other rights are granted.

8. Service Availability

We strive to keep the Services available and reliable but do not guarantee uninterrupted operation. We may perform maintenance, update features, or modify the Services from time to time. We are not liable for any downtime, data loss, or impact resulting from such changes, except as required by mandatory law.

9. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be error-free or that any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, Endelbyte srl, its affiliates, and its personnel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Services. Our aggregate liability for any claim relating to the Services shall not exceed the amount you paid to us in the twelve months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Termination

You may stop using the Services and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we reasonably believe your use poses a risk to the Services or other users. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the "Last Updated" date. Material changes will be communicated through the Services or by email. Your continued use of the Services after the changes take effect constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Italy, without regard to conflict-of-laws principles. The courts of Brescia, Italy shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except where mandatory consumer protection laws grant you the right to bring proceedings in your country of residence.
